Siriusware is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Statement of Privacy applies to the Siriusware website and governs data collection and usage. By using the Siriusware website, you consent to the data practices described in this statement.

Collection of your Personal Information

Siriusware collects personally identifiable information, such as your e-mail address, name, home or work address or telephone number. Siriusware also collects anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests and favorites.

There is also information about your computer hardware and software that is automatically collected by Siriusware. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used by Siriusware for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Siriusware website.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Siriusware public message boards, this information may be collected and used by others.

Use of your Personal Information

Siriusware collects and uses your personal information to operate the Siriusware website and deliver the services you have requested. Siriusware also uses your personally identifiable information to inform you of other products or services available from Siriusware and its affiliates. Siriusware may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Siriusware does not sell, rent or lease its customer lists to third parties. Siriusware may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, Siriusware may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. Siriusware does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent. Siriusware does not knowingly solicit information from children, and we do not knowingly market our products or services to children.

Siriusware keeps track of the websites and pages our customers visit within Siriusware, in order to determine what Siriusware services are the most popular. This data is used to deliver customized content and advertising within Siriusware to customers whose behavior indicates that they are interested in a particular subject area.

SAFE HARBOR PRIVACY POLICY APPLICABLE TO PERSONAL DATA FROM NATURAL PERSONS WITHIN THE COUNTRIES OF THE EUROPEAN UNION

Protecting personal information is very important to Siriusware. Therefore, this Safe Harbor Privacy Policy (this "Policy") sets out the privacy principles that Siriusware follows with respect to transfers of Personal Data (as defined below) from the twenty-five (25) member states of the European Union (the "EU") (Austria, Belgium, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden and the United Kingdom) to the United States.

Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (the "Directive") permits transfers of Personal Data from an EU member state to a non-EU member state only if such non-EU member state provides an "adequate level of protection." The United States Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions regarding the transfer of Personal Data from the EU to the United States (the "Safe Harbor Principles") that satisfy the "adequate level of protection" requirement of the Directive. Siriusware, consistent with its commitment to protect personal information, adheres to principles consistent with the Safe Harbor Principles.

For purposes of this Policy, the term "Personal Data" means any information relating to a natural person within the member states of the EU who is identified or who can be identified directly or indirectly in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity. For purposes of this Policy, the term "Data Subject" means the natural person who is identified or identifiable by such Personal Data.

Siriusware adheres to the following principles that are consistent with the Safe Harbor Principles:

 

1. Notice:  At the time when Siriusware first asks a Data Subject to provide Personal Data to Siriusware or as soon thereafter as is practicable, but in any event before Siriusware uses such Personal Data for a purpose other than the purpose(s) for which it was originally collected or discloses it for the first time to a third party, Siriusware will inform such Data Subject in clear and conspicuous language of: (a) the purpose(s) for which Siriusware collects and uses such Data Subject's Personal Data, (b) how such Data Subject can contact Siriusware with any inquiries or complaints about such Data Subject's Personal Data, (c) the types of third parties to whom Siriusware discloses such Data Subject's Personal Data, and (d) the choices and means that Siriusware offers such Data Subject for limiting the use and disclosure of such Data Subject's Personal Data.

2. Choice:  Siriusware will offer a Data Subject the opportunity to choose (opt-out) whether such Data Subject's Personal Data is: (a) to be disclosed to a third party, or (b) to be used for a purpose other than the purpose(s) for which it was originally collected or subsequently authorized by such Data Subject. Siriusware will offer a Data Subject clear and conspicuous, readily available mechanisms to exercise such choice.

When the following categories of Personal Data are involved: personal information specifying (a) medical or health conditions, (b) racial or ethnic origin, (c) political opinions, (d) religious or philosophical beliefs, (e) trade union membership, or (f) information specifying the sex life of the Data Subject (collectively referred to as "Sensitive Personal Data"), Siriusware will offer Data Subjects affirmative or explicit (opt-in) choice if the Sensitive Personal Data is to be disclosed to a third party or used for a purpose other than the purpose(s) for which it was originally collected or subsequently authorized by the Data Subject. Siriusware also treats as Sensitive Personal Data any information that it receives from a third party when such third party treats and identifies such information as Sensitive Personal Data.

3. Onward Transfer: Siriusware will disclose Personal Data to third parties pursuant to the Notice and Choice principles set forth above. In the event that Siriusware wants to transfer Personal Data to a third party that is acting as its agent, Siriusware will, prior to such transfer, obtain assurances from such third party that it: (a) subscribes to the Safe Harbor Principles, (b) is subject to the Directive, (c) is subject to another "adequate level of protection" finding, or (d) will enter into a written agreement with Siriusware requiring that the third party provide at least the same level of privacy protection as is required by the relevant Safe Harbor Principles.

4. Security:  Siriusware takes reasonable precautions to protect Personal Data from loss, misuse and unauthorized alteration, destruction, access and disclosure.

5. Data Integrity:  Siriusware will not process Personal Data in a manner other than the purpose(s) for which it: (a) has been collected, or (b) has been subsequently authorized by the Data Subject. Siriusware will take reasonable steps to ensure that Personal Data is current, accurate, complete and relevant for its intended use.

 

6. Access:  Upon a written request to Siriusware, Siriusware will grant a Data Subject reasonable access to such Data Subject's Personal Data that Siriusware possesses. Siriusware will correct, amend or delete any Personal Data that is shown, to Siriusware's reasonable satisfaction, to be out of date, inaccurate, incomplete or no longer necessary for the purpose(s) for which it was collected or subsequently authorized by the Data Subject.

7. Enforcement:  Siriusware will conduct compliance audits of its adherence to the principles set forth in this Policy from time to time and will establish follow up procedures for verifying that its attestations and assertions about its privacy practices are true and that its privacy practices have been implemented as presented in this Policy. In the event that Siriusware determines that any of its employees are in violation of the principles set forth in this Policy, Siriusware will subject such employee(s) to appropriate disciplinary action, up to and including termination of employment.

Siriusware will investigate and attempt to resolve complaints and disputes regarding the use and disclosure of Personal Data in accordance with the principles contained in this Policy. In the event that complaints cannot be resolved between Siriusware and any complainant, Siriusware will cooperate and participate in the dispute resolution procedures of the panel established by the EU data protection authorities to resolve such disputes.

This Policy may be amended by Siriusware from time to time, provided that such amendments are consistent with the requirements of the Safe Harbor Principles.
